County Court money claim

If payment has not been received following a Letter Before Action or Late Payment Demand then issuing Court Proceedings can be pursued to recover your debt.

We issue County Court Claims online.  Issuing proceedings online has advantages for our clients; the Court fees are reduced and the claim is progressed more speedily.

The claim will specify the following;

  • Debt Amount
  • Any Contractual costs
  • Late Payment, County Court or contractual Interest
  • Statutory Compensation
  • Solicitors recoverable costs

We will lodge the County Court claim on the same day of receipt.  Once the Court serves the claim, the debtor will have 14 days in which to respond. There is a Court Fee to issue a Money Claim starting at £35.00 a single case and rising up to 5% of the debt.  The Court Fee and part of our costs are recoverable from your debtor if your claim is successful and we provide cost certainty through our fixed fee product.


The debtor may respond in one of the following ways;
  • Pay the outstanding amount in full
  • Negotiate terms to settle
  • Defend the claim
  • Ignore the Claim

Most debts are paid within 14 day specified period or the defendant will have to lodge an acknowledgment confirming that the debtor proposes to defend. The debtor must then lodge a Defence 14 days thereafter. If no step is taken by the debtor, then you can enter a Default Judgment.  We will not obtain a County Court Judgment until you instruct us to do so.

If a Default Judgment is entered, the debtor will be advised that a County Court Judgment will become registered after 28 days unless payment is made, which will affect the debtor`s credit rating for 6 years or more.
